Expungement Requests

The Records Section accepts and collects the initial fee and application for the process of restricting arrest records (expungement) requests.

  1. O.C.G.A §35-3-37 provides for the restriction of certain criminal history records for non-criminal justice purposes when approved by the prosecuting attorney.
  2. For arrests prior to July 1, 2013 the applicant is required to apply for restriction at the arresting agency.
  3. For arrests occurring July 1, 2013 or later, there is no application process. The prosecutor may approve the restriction at the time of sentencing. If restriction is approved upon sentence completion, it should be noted in the sentencing documentation forwarded to the court.

Fees

  • Total fee amount if application is approved is $50 (authorized under O.C.G.A. §35-3-37)
  • $25 per application (non-refundable)

*The Fayette County Sheriff's Office will only accept: 

  • Exact cash
  • Business checks
  • Certified checks
  • Money orders made payable to The Fayette County Sheriff's Office

No personal checks.

Application Information

If approved by the prosecutor, the application will be mailed to the applicant. It will be the applicant's responsibility to forward the approved Request to Restrict Arrest Record form to G.C.I.C. (Georgia Crime Information Center) along with a $25 (money order or certified check) fee made payable to "Georgia Bureau of Investigation."
